Employer, PA plead not guilty to hitting bodyguards who fast

KLANG – A businessman who slapped, assaulted and pointed a pistol at his two bodyguards who fasted pleaded not guilty to five counts of charges at the Magistrate Court today.

The accused, Chun Chee Yang, 43, made the not guilty plea after all charges were read to be before Magistrate P. Sarulatha.

According to the charges, Chee Yang, on 13 April 2021, between 10.30 pm and 11.30 pm had intimidated Mohd Azminizam Zulkepli, 44, outside his house compound at Jalan Batu Nilam 9, Bandar Bukti Tinggi, Klang by threatening to seriously injure him with a pistol pointed at him.

The case is framed under Section 506 of the Penal Code and is punishable under the same section of the code.

For the second count of charge, Chee Yang, on 13 April 2021, between 10.30 pm and 11.30 pm abetted his personal assistant Choo Hin Voon, 43 and instructed him to voluntarily cause injury to Ahmad Samsuri Zailani, 27, by using a cane as the weapon outside his house compound at Jalan Batu Nilam 9, Bandar Bukti Tinggi, Klang.

The case is framed under Section 109 of the Penal Code, read together with Section 324 of the Penal Code.

On the third count of charge, Chee Yang, on 13 April 2021, between 10.30 pm and 11.30 pm had instructed Hin Voon to voluntarily cause injury to Mohd Azminizam, by using a cane as the weapon outside his house compound at Jalan Batu Nilam 9, Bandar Bukti Tinggi, Klang.

The third charge is framed under Section 109 of the Penal Code, read together with Section 324 of the Penal Code.

On the fourth count of charge, Chee Yang on 13 April 2021, between 10.30 pm, had uttered words with deliberate intention of wounding the religious feelings of Mohd Azminizam and Ahmad Samsuri outside his house compound at Jalan Batu Nilam 9, Bandar Bukti Tinggi, Klang.

Among the words he uttered were, “Do you want to follow me or Allah?” “Who paid for your salary – Allah or I?” “Can Allah look after you or I?” “Can your Allah give you money?” and “If you want to work for me you cannot fast.”

Chee Yang is investigated under Section 298 of the Penal Code and is punishable under the same Section for all four charges.

Meanwhile, on the fifth count of charge, Chee Yang, on 13 April 2021, between 10.30 pm, had intentionally caused injury to Mohd Azminizam at the same venue. The charge is framed under Section 323 of the Penal Code.

Earlier, Deputy Public Prosecutor Asyraf Ashyari Kamaruzaman and Mohd Fakhrurrazi Ahmad offered RM200,000 bail for each charge besides requesting the passport of the accused to be surrendered to the court. They also requested additional condition, where the accused needs to report himself to the nearest police station until the case is completed.

Nevertheless, Defence Counsel Abdul Hakim Aiman and Loi Yap Loong pleaded for the bail to be reduced as the accused could not flee. His business is based in Klang and he also grew up in Klang. Besides that, he also has a huge commitment with 30 workers.

Chee Yang’s parents are also living with him and they are sick with intestine cancer. He also needs to support two schooling children and his wife who is a full time housewife.

In the similar proceeding, his Personal Assistant, Hin Voon, pleaded not guilty after two charges were read to him before Magistrate P. Sarulatha.

On the first count of charge, Hin Voon, on 13 April 2021, between 10.30 pm, had intentionally caused hurt to Mohd Azminizam by using a cane as a weapon outside a house compound at Jalan Batu Nilam 9, Bandar Bukti Tinggi, Klang

Meanwhile, Hin Voon, on 13 April 2021, between 10.30 pm, was also charged for the second count of intentionally causing hurt to Ahmad Shamsuri by using a cane as a weapon at the same venue.

He was charged for committing the two offences under Section 324 of the Penal Code.

The prosecutors offered RM100,000 for each count of charge and the accused needs to report himself to the nearest police station.

Lawyers Abdul Hakim and Yap Loong requested for the bail to be reduced as the accused suffers from hypertension and hyperglycaemia that requires insulin injection twice a week.

Magistrate P. Sarulatha however allowed both the accused to be bailed at RM50,000 and RM20,000 for all charges.
