KUALA LUMPUR – The Court of Appeal has discharged an acquitted Datuk Seri Tengku Adnan Tengku Mansor from his RM2 million corruption charges and 12-month jail sentence.
The verdict was delivered by a three-member bench comprising of Judge Datuk Abu Bakar Jais and Judge Ahmad Nasfy Yasin and led by Datuk Suraya Othman. They set aside the conviction, 12-month jail and RM2 million fine sentenced on the former Minister of Federal Territories by the Kuala Lumpur High Court last year with a 2-1 vote.
While delivering the verdict, Suraya said the High Court judge had made an error in his judgement and there was also no evidence to show that the key witness in the case, property tycoon Tan Sri Chai King Kong, had been dishonest when testifying.
“Thus, we allow the appeal and set aside the appellant’s conviction,” she said.
On 21 December last year, High Court Judge Mohamed Zaini Mazlan delivered the verdict and sentence on Tengku Adnan after finding him guilty and failed to raise reasonable doubts at the end of the prosecution case.
The court however, allowed the Member of Parliament of Putrajaya’s application for a stay of execution pending his appeal.
He was charged with receiving a total of RM2 million from Aset Kayamas Sdn Bhd’s Director, Tan Sri Chai Kin Kong via a cheque deposited into a bank account owned by Tadmansori Holdings Sdn Bhd in which Tengku Adnan has a an interest.
Tengku Adnan, who is currently the Treasurer-General of UMNO was accused of committing the offence at CIMB Bank Berhad, Damansara Town Centre branch on 14 June 2016. –MalaysiaGazette
