PETALING JAYA – No plea was recorded from a former nasyid singer and composer after he was charged at the Magistrate Court with trafficking cannabis on 24 March.
The accused, Muhammad Yasin Sulaiman, 46, only nodded and said that he understood the charges before Magistrate Zhafran Rahim Hamzah.
According to the charge paper, ge was charged with the distribution of dangerous drugs, cannabis weighed 214 grammes on 24 March 2022, 5.30 pm at his house, No A-12-5, Casa Indah Kondominium, Persiaran Surian Damansara Indah Resort Home, Kota Damansara. The charge was framed under Section 39B(1)(a) of the Dangerous Drugs Act 1952 and is punishable under Section 39B(2) of the same Act, which carries the death penalty of life imprisonment. If an accused is not sentenced to death, a convicted person could be sentenced up to 15 whippings.
Earlier, the Selangor Prosecution Director, Mohammad Al-Saifi Hashim requested the court to deny bail se Section 41(B) of the Dangerous Drugs Act do not allow bail on cases with death penalty.
However, the defence counsel, Yusmadi Yusoff said that his client is still in trauma after his divorce and has two schooling children and sick parents.
Yusmadi also insisted for Yasin to be allowed bail, including with two sureties as his client requires immediate treatment at the hospital for bipolar or serious mental problem.
He added, the Petaling Jaya District Police Chief, Assistant Commissioner Mohamad Fakhrudin Abdul Hamid also said in a news conference that the accused was not involved with the distribution or sales of the cannabis as the drugs found in his house were for his personal use.
However, the prosecution questioned his arguments of using a news paper report when the police did not make a statutory declaration at the court.
After considering the arguments, Magistrate Zhafran Rahim did not allow bail and ordered the defence to make an application for his client to be treated at the hospital.
The court also set 18 May 2022 for the mention of case and management of chemical report from the prosecution. -MalaysiaGazette
