5 years jail for man who hit wife for rejecting sexual advances

MELAKA – A labourer was sentenced to five and a half years in prison for hitting his wife after she rejected his sexual advances.

Judge Maziah Joary Mohd Tajudin and Judge Narian Badruddin passed the sentence to V. Murugan, 30 on four counts of charges at the Ayer Keroh Court Complex.

According to the first charge, the man who worked at a scrap metal shop was found guilty of intentionally hurting his wife, A.M. Saraswathi, 24, by hitting the victim’s head with a helmet.

The accused also hurt his son, M. Sivaneswaran, 6, by beating his right shoulder with a USB phone cable.

The man was charged under Section 324 of the Penal Code and read together with Section 326A of the similar act which carries the maximum 20 years of jail sentence or whipping or both.

According to the third charge, the accused was found guilty of criminal intimidation against his wife by placing a machete on her neck. He was charged under Section 506 of the Penal Code which carries the maximum sentence of seven years or fine or both.

The accused was charged with committing the offence at a house at Ujong Pasir, Melaka Tengah district at around 6.00 pm on 9 October 2021.

On the fourth count of charge, the accused was found guilty of intentionally causing hurt to his wife by kicking her chest, causing her to fall at about 10.00 am the following day.

The accused was charged under Section 323 of the Penal Code and read together with Section 326A of the same act which provides a jail sentence of up to two years or RM2,000 fine or both.

Based on the case fact, the incident happened when he was drunk and he threatened and beat his wife after the victim refused to have sex with him.

The accused son saw what happened and started screaming before he was beaten with the phone USB cable.

The two courts then sentenced him to five years and six months in prison from the date the accused was arrested on 10 October. -MalaysiaGazette
