KUALA LUMPUR – Perbicaraan SRC International Sdn Bhd hari ini dikejutkan dengan pendedahan saksi ke-15, Tan Sri Dzulkifli Ahmad bahawa Datuk Seri Najib Tun Razak pernah cuba didakwa oleh Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) sekitar 2015.
Dzulkifli merupakan bekas Ketua Pesuruhjaya SPRM pada masa penyiasatan terhadap dana bernilai RM2.3 bilion sedang dijalankan oleh agensi terbabit bersama-sama Jabatan Peguam Negara.
Dzulkifli juga mendedahkan pada awalnya beliau sangat terkejut dengan cadangan SPRM mahu mendakwa Najib yang merupakan Perdana Menteri ke-6 ketika itu di bawah Seksyen 403 Kanun Keseksaan atas jenayah pecah amanah penyewelangan.
Selain daripada Seksyen 403, SPRM juga ada memberikan cadangan untuk mendakwa Najib yang juga Ahli Parlimen Pekan mengikut Seksyen 23 Akta SPRM.
Beliau ketika itu merujuk kepada penemuan awal SPRM berhubung kertas siasatan melibatkan dana RM2.6 bilion dan RM42 juta SRC yang diberikan kepada peguam negara ketika itu.
Kertas siasatan itu telah diberikan oleh bekas Peguam Negara ketika itu, Tan Sri Apandi Ali pada awal Januari 2016.
Bagaimanapun, kata bekas Timbalan Pendakwa Raya di Jabatan Peguam itu, pihaknya kemudian berpuas hati apabila kertas siasatan dikembalikan dengan hasil siasatan membuktikan dana RM2.3 bilion itu sebenarnya adalah derma dari keluarga Diraja Arab Saudi.
Dzulkifli berkata demikian ketika pemeriksaan utama petang tadi dengan peguam bela, Tan Sri Muhammad Shafee Abdullah di hadapan Hakim Mahkamah Tinggi, Mohd Nazlan Mohd Ghazali.
“Saya terkejut bila SPRM mencadangkan supaya beliau (Najib) yang juga Perdana Menteri didakwa di bawah Seksyen 403 dan Seksyen 23 Akta SPRM.
“Kami telah diberikan kertas siasatan penemuan awal berkaitan dana 1Malaysia Development Berhad (1MDB) dan juga wang bernilai RM42 juta SRC International. Saya kemudian menubuhkan sebuah pasukan khas Jabatan Peguam dan juga SPRM.
“Siasatan kami menjurus kepada adakah benar penyewelengan dilakukan oleh Najib selain daripada mengkaji sejauh mana beliau mengetahui tentang skandal ini.
“Kami juga ingin tahu adakah beliau sedar wang sebanyak itu masuk ke dalam akuan peribadinya juga adakah beliau sendiri telah memberikan arahan untuk perkara sedemikian.
“Tetapi apabila tamat siasatan, kami SPRM dan Jabatan Peguam gembira dengan keputusan yang membuktikan beliau tidak ada kaitan dengan salah laku ini. Kes ini kemudian di klasifikasikan sebagai No Futher Action (NFA),” katanya.
Dzulkifli juga mendedahkan pihaknya bersama-sama Jabatan Peguam Negara telah mengambil inisiatif untuk merekodkan keterangan pelbagai pihak termasuk Najib, keluarga diraja Arab Saudi, Low Taek Jho atau Jho Low juga beberapa individu lain dikaitkan dengan skandal ini.
“Pada pandangan saya, daripada keterangan-keterangan ini sudah membuktikan bahawa wang RM2.3 bilion bukannya dari dana 1MDB sebaliknya derma Arab Saudi. Bagi saya ianya satu ‘done deal’,” ujarnya.
