JOHOR BAHRU – The High Court sentenced Sam Ke Ting, 27 to six years in prison and RM6,000 fine after finding her guilty of reckless driving thus causing the death of eight teenage joyriders five years ago.
Thus, it set aside the verdict of Magistrate Court on 10 October last year for maintaining the verdict to acquit and dismiss the accused from the charges.
The accused was also ordered to serve six months sentence in lieu of fine besides suspending her driver’s license for three years after she serves her jail sentence.
Judge Datuk Abu Bakar Katar delivered the sentence after the prosecution managed to establish prima facie on the case. This is also the second notice of appeal from the prosecution after release of Ke Ting on 11 October 2021.
According to the charge paper, in February 2021, the High Court ordered Ke Ting, to enter her defence. While reading out the appeal from the prosecution, he found was satisfied that the offences under Section 41(1) of the Road Transport Act 1987 have been established.
He said, the court had erred during the proceeding in considering the issues raised during the end of the prosecution trial on the identity of the driver, non-acceptance of exhibit and there was no identification on the victims.
Earlier, the prosecution represented by the Johor State Prosecution Director, Tengku Amir Zaki Tengku Abd Rahman and Deputy Public Prosecutor, Muhammad Syafiq Mohd Ghazali, requested the court to sentence the accused to just punishment, considering the principles of public interest.
However, Ke Ting, who was represented by Lawyer Muhammad Faizal Mokhtar pleaded the court to pass a lighter sentence as this was her first offence and she has to support both her parents.
Muhammad Faizal also requested for a deferment of sentence on his client from the date she was sentenced.
However, his plea was rejected by the court.
The court also ordered her conviction to be recorded in her driver’s licence and she needs to surrender it by tomorrow for further action.
The accused was charged with committing the offence at Jalan Lingkaran Dalam, Johor Bahru, at 3.20 am on 18 February 2017.
The teenagers who died in the fatal accident were Mohamad Azrie Danish Zulkefli, 14, Muhamad Shahrul Izzwan Azzuraimie, 14, Muhammad Firdauz Danish Mohd Azhar, 16, Fauzan Halmijan, 13, Mohamad Azhar Amir, 16, Muhammad Harith Iskandar Abdullah, 14, Muhammad Shahrul Nizam Marudin, 14 and Haizad Kasrin, 16. -MalaysiaGazette
